Copyright Issues
By Adam.
"Copyright protects expression. The Copyright Act of 1976 states
that the items of expression can include literary, dramatic, and
musical works; pantomimes and choreography; pictorial, graphic
and sculptural works; audio-visual works; sound recordings; and
architectural works. An original expression is eligible for copyright
protection as soon as it is fixed in a tangible form."
A Few Words on Registering Copyright:
Current copyright law protects original artwork from the moment of
its creation, regardless of registration. However, registration offers
obvious legal benefits in the event copyright for a particular work
comes into dispute (in court, the registration acts as prima facie
evidence, meaning the other party has the burden of disproving it).
Registering copyright costs $20 (in the US). Fortunately, for all us
artist hobos, multiple artworks may be grouped together under a single
title and registered for a single $20 fee, provided all works in the
group are unpublished.
For more information on registering copyright (in the US) and for
downloadable registration forms, visit the US Copyright Office Home
Page.
*Note: Regardless of registration, it's always a good idea to
inscribe a copyright notice on your work to prevent so-called innocent
infringers from "unwittingly" stealing your work.
*Special Note on Pseudonyms (Stage/Pen Names):
Choosing a pseudonym does not hinder an artist's ability to register
for copyright (a provision is made for pseudonyms on the registration
forms). Note however that pseudonyms themselves, just like any other
name, may not be copyrighted. Therefore it's advisable, though not
necessary, that you include your legal name on the registration form
along with your pseudonym (who's to say no one will steal your
pseudonym?) For more info on registering for copyright with a
pseudonym, see FL
101.

Ann Waugh (cwaugh@sni.net) has found a
good web resource: "It's called The Publishing Law Center and it has 19 articles on legal
issues of concern to publishers, editors, writers and authors. These
articles cover contracts, copyright, fair use, public domain, subsidiary
rights, electronic rights and more."
